0. Introduction

KicksDB (formerly known as SneakersAPI) provides access to sneaker and apparel market data via API. References to “SneakersAPI” in past documentation or agreements now apply to KicksDB.

1. Acceptance of Terms

By using kicks.dev, you agree to abide by these Terms of Service. If you do not agree with any part, you should discontinue use.

2. API Usage and Access

  • Permitted Use: You may use, cache, resell, or redistribute the API data provided by kicks.dev.
  • API Access Limits:
    • Free Plan: Limited to 50,000 requests per month.
    • Pro Plan: Limited to 5,000,000 requests per month for 30€/month.
    • Enterprise Plan: Limited to 10,000,000 requests per month for 100€/month.
  • Restrictions:
    • API keys are unique to your subscription and should not be shared.
    • Abuse or violation of the terms may result in immediate cancellation of your API key and subscription without refund.

3. Billing and Payments

  • Billing Cycle: All subscriptions are billed on a monthly basis and automatically renew unless canceled before the next billing cycle. You can cancel anytime via your account dashboard.
  • Refund Policy: kicks.dev offers refunds only if requested within the first 7 days after subscription.
  • Overage Policy: kicks.dev does not support overages. Any requests exceeding the plan limit will be blocked until the next billing cycle.

4. Data Accuracy and Disclaimers

  • Data Disclaimer: kicks.dev aggregates data from multiple sources. While we strive to clean data and ensure accuracy, we are not liable for inaccuracies or outdated information.
  • Brand Affiliation: kicks.dev is not affiliated with any brands, including Nike, StockX, or other entities.

5. User Conduct and Fair Usage

  • Users are expected to adhere to fair usage practices. Any spamming or abusive usage may result in service termination. Abuse includes, but is not limited to, excessive API calls beyond fair usage intent, automated account creation, or activities that disrupt service stability.
  • kicks.dev does not impose specific usage restrictions but reserves the right to terminate access in cases of abuse.

6. Intellectual Property

  • kicks.dev does not claim ownership of third-party data accessed through the API. However, users are not permitted to claim ownership over any proprietary aspects of kicks.dev itself.

7. Limitation of Liability

  • Uptime: kicks.dev aims to maintain a 99% uptime. We are not liable for any service interruptions.
  • Data Accuracy: We are not responsible for any direct or indirect damages due to data inaccuracies, and we disclaim all warranties related to data quality.

8. Privacy and Data Collection

  • Data Collected: We collect minimal personal information, including email, billing information through Stripe, and usage metrics.
  • Data Storage and Sharing: User data is stored on kicks.dev’s secure servers and on Stripe for billing purposes. We do not sell or share data with third parties.
  • Data Retention: Personal data is retained as long as your account is active and for a maximum of 2 years after inactivity (based on last login date), unless requested for deletion.

9. Amendments to the Terms

kicks.dev may update these Terms of Service periodically. Continued use constitutes acceptance of any updated terms.

10. Governing Law

These Terms of Service are governed by the laws of France, without regard to conflict of laws principles.
